These terms cover the Eternal NYE mobile app and this website. They do not cover your ticket — that is a separate contract with the ticket seller.

Agreeing to these terms

By using the Eternal NYE app or this site you accept these terms. If you do not accept them, do not use the app.

What the app is, and what it is not

The app is a companion to the festival: the schedule, the lineup, the site map, vendors, announcements and general information. It is built to keep working without a signal, which means some of what it shows you was downloaded earlier and may since have changed.

It is not your ticket, and it is not proof of entry. Set times, artists, stages, vendors and site layout can change, sometimes at short notice and sometimes during the event. We do our best to keep the app current, but the festival on the ground is the authority, not the screen.

Tickets and entry

Tickets are sold by Front Gate Tickets. Their terms, refund rules and privacy policy govern your purchase. Entry to the festival is governed by the event's own conditions of entry, including its 18+ age requirement, its bag and prohibited items policy, and the right to refuse or revoke entry.

Crew, and how people are expected to behave

Crew lets you publish a handle, a display name and a photo, connect with friends, and see the sets they have saved. Anything you publish there is content you are responsible for.

There is no tolerance for objectionable content or abusive behaviour. That includes harassment, threats, hate speech, sexual content, impersonating somebody else, and using a photo you have no right to use.

  • You can report any profile from the app, and you can block anyone. Blocking is mutual and immediate.
  • Reports go to a moderation queue that festival staff review. We aim to act on reports of objectionable content within 24 hours.
  • We can remove a photo, remove a profile, or stop an install from using Crew, without notice, where we judge these rules to have been broken.
  • Removing content is not the same as removing a report about it. Reports are kept even when the profile they concern is deleted.

Lost & Found

Lost & Found is offered as a convenience. Filing a report does not create any duty on our part to find, hold, store or return anything, and we are not responsible for property lost at the event.

Claiming an item you know is not yours is a form of theft, and we will treat it as one. Claims are verified in person at the booth.

Using the app fairly

  • Do not attempt to access other people's data, staff-only features, or the festival's administrative systems.
  • Do not scrape, resell or republish festival content from the app or its API.
  • Do not interfere with the service, or with anyone else's use of it.
  • Do not use the app to break the law.

Content you submit

You keep ownership of what you upload. By uploading it you give us permission to store, display and distribute it inside the app for the purpose of running the feature you used it for — showing your profile photo to your crew, for example. That permission ends when you delete the content, except where we are required to retain something, such as a report.

Availability

We do not promise the app or its services will always be available, complete or error-free. Parts of it depend on servers, networks and third parties we do not control, and a festival site is a hostile place for mobile data. The app is designed to degrade gracefully rather than to guarantee uptime.

Other services and links

The app links out to ticketing, streaming services, sponsors, vendors and maps operated by other people. Those links are for convenience and we are not responsible for what is on the other end of them.

Our content

The Eternal NYE name, logo, artwork, photography and the app itself belong to us or to our partners and licensors, and may not be copied or reused without permission. Artist names, images and logos belong to the artists.

Disclaimers and liability

The app is provided as-is and as-available, without warranties of any kind to the fullest extent the law allows. To the fullest extent the law allows, we are not liable for indirect or consequential losses, or for anything arising from a set time that changed, a notification that did not arrive, property that was not recovered, or information in the app that was out of date.

Nothing here limits liability that cannot lawfully be limited.

Changes to these terms

We may update these terms. The date at the top will change, and continuing to use the app after that means you accept the update.

Governing law

These terms are governed by the laws of the State of Florida, United States, and the courts of Orange County, Florida will have jurisdiction over any dispute.
